Fines for violating silence are to be increased in the Nizhny Novgorod region. The corresponding bill has been published on the regional government’s website and put out for public discussion.
As stated in the explanatory note to the document, recently the number of citizens’ complaints regarding violations of the law “On Ensuring Silence and Peace” (Law of the Nizhny Novgorod Region of April 1, 2015 No. 44‑Z) has increased.
Those violating the silence are cafes, bars and other establishments located on territories adjacent to apartment buildings and selling alcoholic products. The law is also violated at night during the construction of infrastructure facilities.
“The penalty currently in place does not encourage participants in legal relations to lawful behavior, which indicates its ineffectiveness,” the explanatory note says.
When drafting the bill, practices from the Kirov, Pskov and Yaroslavl regions were analyzed.
The draft law provides for a multiple increase in the amount of the administrative fine for violation of citizens’ silence and peace: for officials — from 5,000 to 10,000 rubles; for legal entities — from 10,000 to 20,000 rubles. For a repeated offense the fines for officials will be from 10,000 to 20,000 rubles, and for legal entities — from 20,000 to 30,000 rubles.
Fines for individuals will remain the same (3–4 thousand rubles for the first offense and 4–5 thousand rubles for a repeat).
