      From September 1, 2025, a government decree comes into force that introduces new criteria for recognizing land plots as unused. These rules will be in effect until September 1, 2031, and affect lands within the boundaries of populated areas, as well as garden and allotment territories.

      As explained by Deputy Head of the Rosreestr Office for the Nizhny Novgorod Region Maksim Paikov, different signs of non-use have been established for different categories of plots. For household, garden and allotment lands, as well as territories where construction is prohibited, the main criterion is overgrowing of more than half the area with grass over one meter high, shrubs or trees. If such a situation persists for a year after its detection, the plot may be declared unused.

      "Theoretically, such neglect of land was considered a violation before as well. But it was difficult to punish the owners of such plots — how to prove that the land is really not being used? For example, if there are a few raspberry bushes on the territory, this could be considered elements of a garden," Maksim Paikov told NIA "Nizhny Novgorod" in an interview.

      Cluttering and pollution are also considered signs of non-use. Cluttering is understood as the presence on more than 50% of the area of items not related to the land’s designated use, and pollution — the presence of waste, including municipal solid waste. For plots intended for construction, the signs are supplemented by the absence of buildings for more than five years (if the plot is not for individual housing construction), the absence of a residential house for more than seven years (if the plot is for individual housing construction), as well as the presence of ruined buildings if the owner has not remedied the problem within a year after its detection. An exception is made for buildings subject to demolition or reconstruction.

      Owners of garden and allotment plots are given three years to develop the land, including removing garbage, clearing weed vegetation, leveling the plot, and carrying out land improvement and reclamation. If the plot is intended for construction, an additional five years are provided to erect and register buildings — eight years in total. For individual housing construction the period is ten years. Violations related to cluttering or destruction of buildings may be recorded not earlier than three years after the registration of rights. If the plot was acquired before March 1, 2025, the count will start on March 1, 2028. A violation for the absence of capital buildings may be established not earlier than eight years from the moment of registration of rights. For plots purchased before March 1, 2025, this period will begin on March 1, 2033.

      After violations are detected, the owner will be sent a warning. If they do not take measures, local authorities will be able to go to court demanding seizure of the plot and its sale at auction.
