
The Federal Antimonopoly Service found a violation in the contract to reinforce the slopes of the Nizhny Novgorod Kremlin.

The Moscow Arbitration Court dismissed the claim of the Administrative Office of the Government of the Nizhny Novgorod Region, which sought to challenge the Federal Antimonopoly Service’s (FAS) ruling that the law was violated in the awarding of a contract worth 331.6 million rubles. The court’s decision was published in the arbitration case file.
The case concerns the reconstruction of anti-landslide structures along Kremlin Boulevard between the Koromyslova and Taynitskaya towers. The contract was signed in August 2024 with the state enterprise "DiRON" without a tender, as a single-source procurement. But the FAS found that there was no urgency to justify this method. The court agreed.
The case notes that a heightened readiness regime was introduced on this section back in 2020, and the mayor’s decree on the need for the work appeared several months before the contract was signed. Moreover, almost 10 months were allotted for the completion of the work, with the possibility of extension until the end of May 2025. All of this, in the court’s view, indicates the absence of an emergency situation.
The inspection was prompted by a complaint from lawyer Alexander Kulakov, who specializes in government contracts. He pointed out that the procurement violated the principles of competition. The FAS conducted an inspection and confirmed that the contract had been concluded in violation of the law.
The Administrative Office insisted that in spring 2024 serious deformations were recorded on the slope that could threaten the stability of the area. However, the court found that there was sufficient time to hold open tenders and that urgency was not proven.
The claim was dismissed, and the applicant was ordered to pay the state fee. The decision can be appealed within a month.
Earlier it was reported that 1.8 million rubles were allocated for mowing the grass on the slopes of the Nizhny Novgorod Kremlin.
