      The Ninth Arbitration Appeal Court supported the position of the Prosecutor's Office of the Nizhny Novgorod Region and ordered the professional association of builders to compensate the municipal budget for damages amounting to over 116 million rubles. This was reported by the Prosecutor's Office of the Nizhny Novgorod Region. Serious violations in the execution of state contracts were revealed during the inspection. In October 2020, the Municipal State Institution "Borstroyzakazchik" entered into contracts with LLC "ISB" for the construction of a kindergarten for 240 places in the Krasnogorka microdistrict and a pedestrian bridge in the city of Bor. However, the contractor was unable to fulfill its obligations. As a result, the customer had to conduct procurement procedures anew and search for a new contractor, which led to additional budget expenses amounting to over 116 million rubles. Since the violating company did not compensate for the losses due to the initiated bankruptcy procedure, the prosecutor filed a lawsuit against the self-regulatory organization (professional community) of which this contractor was a member. Such associations bear subsidiary liability for the actions of their participants. The Arbitration Court fully satisfied the claims of the Prosecutor's Office. The supervisory authority emphasized that the actual execution of the court's decision to recover funds has been placed under special control.
