The agency was pointed out the need for a more thorough examination of trademark registration applications. The Intellectual Property Court upheld a private ruling issued regarding Rospatent. The agency was instructed to take into account the norms of civil legislation and to study designations more carefully when registering trademarks. The decision is related to a legal dispute with a Nizhny Novgorod company. The reason was the use of the trademark "I love my family." This was reported by "Kommersant Privolzhye." Earlier, the Nizhny Novgorod company was required to pay 10.7 billion rubles for the use of the trademark. The first-instance court partially satisfied the claims, ordering a payment of 766 million rubles and prohibiting the use of the disputed designation. Later, the Intellectual Property Court overturned this decision. The instance pointed out that the specified phrase is a common expression, does not serve the function of individualizing the product, and does not create competitive advantages. However, the court noted that registering such a designation as a trademark could be considered an abuse of rights. The cassation appeal was left unsatisfied. In the course of the case, the court separately drew attention to Rospatent's actions. The agency was indicated that when registering trademarks, commonly accepted expressions that do not allow distinguishing one product from another should not be accepted. Attempts by Rospatent to annul the private ruling did not receive the court's support. The decision on the need to revise the agency's approaches remained in force.
