Nizhny Novgorod FAS demands termination of leases for new Pyaterochka stores in Kstovo.

      The Nizhny Novgorod office of the Federal Antimonopoly Service (FAS) is seeking to have lease agreements concluded by Agrotorg LLC — the operator of the Pyaterochka retail chain — in Kstovo declared invalid, the office's press service reported.

      The reason is that the company leased additional retail space despite its share of the local market already exceeding the statutory threshold of 25% of the total volume of food products sold in the previous financial year.

      The agency recalled that, according to part 1 of Article 14 of Federal Law No. 381-FZ, retail chains are not allowed to expand within an administrative-territorial unit if their market share exceeds the established limit. Violating this restriction can lead to reduced competition and higher prices for consumers.

      The FAS has filed lawsuits in the Arbitration Court of the Nizhny Novgorod Region seeking to have the lease transactions declared invalid.

      The office added that it regularly monitors the activities of retail chains for compliance with legal requirements.

      Earlier it was reported that a carrier from Pavlov was caught restricting competition in procurement.
