A resident of Nizhny Novgorod obtained compensation through the courts after snow and ice slid off the roof of a multi-apartment building onto her car. Thanks to the actions of a bailiff, funds were recovered from the homeowners' association (HOA) for the restoration of the car, as well as compensation for moral harm, the regional office of the Federal Bailiff Service (GUFSSP) reported.
The incident occurred in the courtyard of a building managed by the HOA. The owner of the damaged car filed a suit seeking compensation for material damage. The court, having reviewed the circumstances of the case, concluded that the management organization had improperly fulfilled its duties in maintaining the roof and adjacent territory. By court decision, funds were awarded to the injured party for car repairs, compensation for moral harm, and a fine — in total the amount exceeded 500,000 rubles.
After the decision came into legal force, the writ of execution was transferred to the Prioksky District Department of Bailiffs of Nizhny Novgorod. A bailiff notified the HOA of the initiation of enforcement proceedings and explained the procedure and deadlines for voluntary compliance with the court decision.
However, the organization did not take steps to pay off the debt within the prescribed period. Because of this, the bailiff took coercive enforcement measures and imposed a levy on the funds held in the HOA’s bank accounts. Both the principal amount of the debt and the enforcement fee for the delay — more than 27,000 rubles — were debited in full.
As a result of the measures taken, the rights of the car owner, who suffered due to the negligence of the management organization, have been restored.
Earlier it was reported that a mass of snow from a roof had injured bank employees in Nizhny Novgorod.
