The court ordered the contractor to eliminate defects in the park at the source of Lubinka in Diveevo.

      On June 15, 2026, at 11:00, the Arbitration Court of Moscow ordered LLC "Rus-Stroy" to eliminate the deficiencies identified in the recreational park area at the source of the Lubinka River in Diveevo, Nizhny Novgorod Region. The corresponding decision was made based on a lawsuit from the administration of the Diveevo District.

      The dispute concerned a municipal contract for the improvement of public space, concluded in April 2021. The cost of the work amounted to over 78.8 million rubles.

      According to the case materials, in the summer and autumn of 2023, the administration identified a number of defects at the site. In particular, 23 planted trees died—20 willows, one Serbian spruce, and two thuja. Additionally, damage to the fencing, subsidence of the curb stone, destruction of the pavement at the entrance to the baptismal font, deformation of five benches, and a defect in the worship cross were recorded.

      The administration sent claims to the contractor demanding the elimination of deficiencies under warranty obligations, but the work was not completed. After that, the municipality turned to the court.

      Representatives of LLC "Rus-Stroy" stated that the trees could have died due to improper care, and the other defects are a result of normal wear and tear of the facility. However, the court pointed out that the contractor did not provide evidence supporting these arguments.

      The court ordered the company to replace the deceased trees within a month after the decision comes into legal force, restore the fencing and curb stone to proper condition, repair the pavement at the baptismal font and five benches, as well as replace the worship cross.

      The decision can be appealed in the Ninth Arbitration Court of Appeal.
