In such cases, the usual norms of family legislation do not apply, and the rights of the parties differ significantly from those of officially married spouses. The chairwoman of the regional branch of the Russian Lawyers Association, lawyer Irina Fast, explained to NIA "Nizhny Novgorod" what a civil wife can actually expect. According to her, in an unregistered union, the principle does not apply whereby all property acquired during the marriage is automatically considered joint—regardless of who earned the money and in whose name the purchases were made. "A civil wife does not have the same rights as a legal wife to jointly acquired property, meaning that this status, that property is acquired in marriage regardless of who bought what, who spent money, who earned, does not exist. But she has the right to claim the property in which she invested," Fast explained. If, for example, the couple built a house together and both invested funds, but the loan was taken out in the man's name, the woman can still demand her share. "She can claim it not under the family code, but under civil law, because it is her share," the lawyer emphasized. A separate question is how to prove the fact of investments if this was not taken care of in advance. "This is a whole legal process, evidence is gathered. Confirmation can be some transfers, fixed expenses, correspondence in messengers. Evidence can vary," noted Irina Fast. There is no universal algorithm of actions since each situation is individual. However, the lawyer advises women in civil marriages to document their expenses in advance. If building materials, car parts, or other items are purchased with personal funds, it is important to keep receipts and invoices, confirm payment from one's own bank card, and also inform the partner in messages about the purchases made. Communication with the lawyer took place as part of a joint project of the media group NOIC and the Nizhny Novgorod regional branch of the Russian Lawyers Association "So You Know."
