Apartment of Discord: Should Parents Provide Housing for Adult Children?
March 25, 2026 08:30 Economy Member of the Nizhny Novgorod branch of the Association of Lawyers of Russia Marina Shakirova explained whether a child can demand a share in an apartment purchased by parents during marriage without taking out a loan after reaching adulthood, and whether parents are obligated to provide housing for them. In a comment to NIA "Nizhny Novgorod," the lawyer noted that parents have no such obligation. If the apartment was purchased without using maternity capital funds, the child does not gain the right to a share at 16 or 18 years old. After reaching adulthood, they can continue living with their parents, but only with their consent and provided they remain a family member and manage a household together. The law does not require parents to provide separate housing for adult children, even though in practice many try to help with the purchase of an apartment or allocation of a share. At the same time, elderly parents have the right to demand financial support from their children. According to Shakirova, not only elderly parents but also individuals of pre-retirement age—55 for women and 60 for men—can file a lawsuit for alimony. However, it is necessary to prove neediness, for example, if income is insufficient for living due to a small pension and significant expenses on medications. The court also considers the financial situation of the children. A claim may be denied if the child is a disabled person from childhood, is studying full-time, has no income, or is on parental leave. Additionally, the property status of the parents is assessed. If there are savings, real estate, or other assets that can be liquidated, alimony claims may be denied. Shakirova added that such cases occur in judicial practice, but most often small amounts are awarded—1000, 2000, or 3000 rubles per month from each child, or the court denies the claim. Alimony in favor of parents is established only in a fixed monetary amount. According to the lawyer, such measures are usually resorted to when family relationships have effectively already been lost.
