The State Duma proposed compensating losses caused by scammers when buying an apartment.

      Leader of the New People party Vyacheslav Davankov proposed that the Chairman of the Supreme Court of the Russian Federation, Igor Krasnov, develop measures to protect bona fide apartment buyers who have been victims of fraud. This was reported by the publication 360.ru.

      Davankov pointed to a rise in cases of apartment fraud in Russia, affecting both buyers and sellers. According to him, the problem lies in the legal uncertainty that arises when transactions are rescinded.

      Courts generally protect sellers' rights by declaring transactions invalid, but do not always require them to return the money to the buyer. This happens because the funds have already been transferred to the fraudsters. As a result, a bona fide buyer who checked all the documents and paid for an apartment is left without housing and without money.

      Davankov proposed preparing clarifications for the courts that would allow buyers to be compensated for the cost of the apartment at the expense of the fraudsters, if they can be identified. If the fraudsters are not found, the responsibility for returning the funds should be placed on the seller.

      Recall that recently the State Duma has received many complaints about fraud in the secondary real estate market. In connection with this, deputies have begun to consider the possibility of introducing a so-called "cooling-off period" for apartment transactions. Such a mechanism would protect citizens from fraudsters and give sellers and buyers additional confidence in the security of the transaction.
