The appellate court upheld the decision refusing to demolish the building of the Vkus i Dym café in Nizhny Novgorod. The court did not uphold the complaints filed by the city administration and the Ministry of Property of the Nizhny Novgorod Region, writes Kommersant-Privolzhye.
Recall that the proceedings in the case lasted more than two years. In January 2023 the authorities filed a lawsuit against JSC Universam "Nizhegorodsky", whose owner is Klimentyev. The lawsuit alleged that the two-story café of about 400 square meters was built without a permit and extended beyond the boundaries of the leased plot.
In August the arbitration court ruled that the structure should not be demolished but only shifted by 50 square meters onto territory that is not part of the leased plot.
Earlier it was reported that a café in Lyskovo was closed for 90 days due to violations of sanitary norms.
