A nurse from Nizhny Novgorod nearly lost her pension "because of abortions"

      A nurse from one of the maternity hospitals in Nizhny Novgorod secured a recalculation of her employment record and gained the right to an early old‑age insurance pension. The Trade Union of Health Workers helped restore justice.

      According to a post on the official social media page of the Nizhny Novgorod branch of the Union, the woman was initially denied crediting part of her service under the preferential "one year counted as one and a half" scheme. This concerned the period when she worked as a nurse performing pregnancy terminations.

      Olga Romanova, the labor law inspector of the Trade Union’s Central Committee, prepared the lawsuit and represented the employee in court. During the proceedings it was proven that her position had been recorded incorrectly — in fact she performed the duties of an operating room nurse, and pregnancy termination falls into the category of minor gynecological surgeries.

      In addition, the lawsuit included supplementary claims. These included counting a two‑month professional development course toward her special length of service, as well as recalculating three years of work in the gynecology department using the preferential coefficient. Previously these periods had been counted under the ordinary calculation because the employer had not submitted to the Social Fund the necessary information with the codes for preferential work.

      At the recommendation of the regional committee of the Union, the employer submitted corrective data, which made it possible to account for the service in the required amount.

      The court fully granted the claims and issued a decision in favor of the healthcare worker. It was not appealed.

      Now the Union member will be able to retire 3 years and 2 months earlier than the established retirement date. The economic benefit from the decision amounted to more than 800,000 rubles.

      Earlier it was reported that a Nizhny Novgorod nurse had managed to recover 150,000 rubles from her employer.
