July 9, 2026 09:00 Incidents The First Cassation Court of General Jurisdiction confirmed the decisions of lower instances regarding the dispute over the return of the advance for a mini Bichon Frise puppy. This was reported by the court's press service. Earlier, the Kanavinsky District Court of Nizhny Novgorod on November 5, 2025, and then the Nizhny Novgorod Regional Court on February 17, 2026, sided with the buyer. The story began with an advertisement for the sale of dogs from the Republic of Korea, posted online. The woman contacted the seller, planning to purchase a puppy for subsequent breeding. After correspondence and viewing photos and videos, she chose a suitable puppy and transferred 200,000 rubles as an advance. After payment, the buyer had doubts about the health condition of the puppy. The defendant did not refute them, and the plaintiff demanded a refund. The seller stated that the advance was non-refundable and offered another puppy; however, the other options did not meet the stated requirements. The buyer went to court. In response, the seller filed a counterclaim, asserting that the parties agreed not on a purchase but on a service for finding and selecting a puppy, and this service was fully rendered. The court of first instance concluded that a sales contract for the puppy was actually concluded between the parties, rather than an agreement for the provision of services. At the same time, the law "On Consumer Rights Protection" is not applicable in this case, as the dog was purchased for breeding, not for personal needs. Since the transaction ultimately did not take place and the advance was not refunded, the court ordered the seller to pay back 200,000 rubles. Claims for compensation for moral damage, fines, and penalties were denied. The counterclaim was also left unsatisfied. The Cassation Court found no grounds for reviewing the case and confirmed that the money for the failed transaction should be returned.
