The court recovered more than one million rubles from the Nizhny Novgorod DUK for garbage arrears.

      The Arbitration Court of the Nizhny Novgorod Region satisfied the claim of the regional operator for the handling of solid municipal waste, JSC "Sitimatic-Nizhny Novgorod," against one of the housing management companies. The plaintiff was awarded penalties for late payments, as well as expenses for payment of the state fee. The total amount to be paid exceeded one million rubles.

      According to the case materials, in 2018 a contract was concluded between the regional operator and the management organization for the provision of waste removal services in apartment buildings in the Sormovsky district of Nizhny Novgorod.

      Under the terms of the agreement, the management company undertook to pay for the services rendered by the 15th day of the month following the reporting month, on the basis of issued invoices.

      In accordance with part 1 of Article 153 of the Housing Code of the Russian Federation, all consumers — both individuals and legal entities — are obliged to pay for housing and communal services in full and on time.

      At the initial stage of cooperation the parties complied with the terms of the contract. However, beginning in January 2022 the management company began to fall behind on payments, which led to the accumulation of significant arrears. According to the court, the obligations were not fulfilled until February 2025, which formed the basis for filing the lawsuit.

      Regular delays in payments negatively affect the work of waste collection companies. This, in turn, leads to disruptions in the servicing of the housing stock, the accumulation of waste on adjacent residential grounds, and the deterioration of sanitary conditions for residents.

      The court found the arguments of JSC "Sitimatic-Nizhny Novgorod" to be well-founded and ordered the defendant to pay the entire amount of the debt, including accrued penalties and legal costs.
