
A Nizhny Novgorod court refused to demolish Andrey Klimentyev's café.

SocietyA dispute between businessman Andrei Klimentyev and the administration of Nizhny Novgorod over the café "Vkus i Dym" ended not in the mayor’s office’s favor. The Arbitration Court refused to grant the demolition request but obliged the entrepreneur to vacate a public-use area of land that the café partially occupies. This was reported by Kommersant-Privolzhye.
The proceedings lasted more than two years. In January 2023, the city administration and the regional ministry of property filed a lawsuit against JSC "Universam 'Nizhegorodsky'," which is owned by Klimentyev. The authorities claimed that the two-storey café of about 400 square meters was built without permission and extends beyond the boundaries of the leased plot.
According to the plaintiffs, the structure violates land-use rules and partially occupies public-use territory. Representatives of the ministry of property also noted that consent for construction from the lessor had not been obtained, and the building was erected on a recessed foundation, which, in their view, gives it the characteristics of a permanent (capital) structure.
However, two expert examinations concluded that the café is not a capital construction object, and therefore no permit was required for its erection. Klimentyev himself insisted that the building is movable property installed on the site of an old Soviet glass-container collection point. He also stated that he was willing to shift the café three meters further into the yard so as not to violate the plot boundaries.
The judge found the demolition demand unfounded and dismissed the mayor’s office’s claim. At the same time, he partially upheld the position of the ministry of property. Klimentyev’s company was given two months to vacate about 50 square meters of territory that is not part of the leased plot.
The entrepreneur called the decision fair and expressed his readiness to comply with the court’s order. He also noted that the authorities could have taken another route — leasing the disputed plot and receiving income from it for the budget.
The administration of the Nizhegorodsky district told NIA "Nizhny Novgorod" that a decision on filing an appeal in this case will be made after receiving and studying the full text of the Arbitration Court’s decision, within the procedural time limits established by law.
Earlier it was reported that the building of the café "Knyaz" will be demolished in the Leninsky district.
