On June 2, 2026, the Sergach Interdistrict Court of the Nizhny Novgorod Region examined a civil case filed by JSC "Soyuzmultfilm Film Studio" and LLC "Soyuzmultfilm" against an individual who posted advertisements for the sale of goods using the character "Cheburashka" on a marketplace, seeking compensation for the violation of exclusive rights to the trademark and the use of the character's image. The court established that a fact of offering for sale goods possessing technical signs of counterfeiting was identified and documented on the marketplace, containing a designation similar to the degree of confusion with the trademark, the exclusive rights to which belong to JSC "Soyuzmultfilm Film Studio," and the image of the character "Cheburashka" from the animated film "Crocodile Gena," the right to use which belongs to LLC "Soyuzmultfilm." According to the plaintiffs, the defendant's use of the image of the character "Cheburashka" violates their right to use intellectual property objects under the terms of an exclusive license. The defendant did not obtain permission to use the trademark. The plaintiffs demanded that the defendant pay compensation for the violation of exclusive rights in accordance with Article 1301 of the Civil Code of the Russian Federation in the amount of 50,000 rubles each, as well as reimburse legal costs, including expenses for documenting the violation, totaling more than 13,000 rubles. The court recognized the fact of violation of exclusive rights of JSC "Soyuzmultfilm Film Studio" and LLC "Soyuzmultfilm" and satisfied the claims in full. The court's decision has not yet entered into legal force.
