The Gorodets City Prosecutor's Office conducted an inspection of the compliance of the homeowners' association "Youth -7" with the requirements of housing legislation regarding the disclosure of information by organizations engaged in the management of apartment buildings, during which violations were identified. The obligation of the managing organization to ensure free access to certain types of information by placing it in the system is established by part 10.1 of Article 161 of the Housing Code of the Russian Federation (hereinafter - Housing Code of the Russian Federation), as well as part 18 of Article 7 of the Federal Law of July 21, 2014 No. 209-FZ "On the State Information System of Housing and Communal Services" (hereinafter - Federal Law No. 209-FZ). During the inspection, it was established that the official website of the state information system of housing and communal services - www.dom.gosuslugi.ru, did not contain information about the transactions for debiting from the account and crediting to the special account of funds for the capital repair of common property, as well as about the balance of funds in such accounts. The non-disclosure of the information required by the legislation of the Russian Federation on the GIS of Housing and Communal Services website violates citizens' rights to information. In this regard, the city prosecutor's office initiated an administrative offense case against the official, provided for by part 2 of Article 13.19.2 of the Administrative Offenses Code of the Russian Federation - non-disclosure of information in accordance with the legislation of the Russian Federation in the state information system of housing and communal services by persons engaged in the management of apartment buildings and other organizations that are obliged under the regulatory legal acts of the Russian Federation to place information in the state information system of housing and communal services. The material has been sent for consideration to the magistrate's court. A decision on the material has not been made.
