Evgeny Lyulin: "State support measures should be directed to education, not to the repayment of financial obligations"

On November 19, a meeting of the Legislative Assembly committee on social issues was held. At the meeting, deputies discussed a draft federal law aimed at protecting the state social scholarship from garnishment under enforcement orders.
The social scholarship is awarded to students who are particularly in need of state support. These are orphans, people with disabilities, combat veterans, students from low-income families and other categories. Deputies believe these funds should be used for students’ material support, not for repaying financial obligations. As practice has shown, cases of garnishing such scholarships have already occurred in a number of regions of Russia, including Nizhny Novgorod Oblast.
“A young man who receives a social scholarship because he is a child left without parental care contacted us. He disagreed with the deduction from these already modest funds. We began to investigate and found that this is not an isolated case but a systemic problem. The state social scholarship is targeted support from the state for food, travel, stationery, not extra money. Our task is to include it in the list of incomes that cannot be subject to garnishment, so that such a story does not repeat itself with any student,” said Natalya Smotrakova, chair of the regional parliament’s committee on social issues.
The meeting noted that the current law “On Enforcement Proceedings” protects many social payments from debt collection, such as pensions and allowances. However, the state social scholarship is not included in that list. This means that funds intended to support vulnerable categories of students can be seized to repay their debts. According to the parliamentarians, this legal gap means that this form of material support loses its original purpose.
Members of the committee supported the legislative initiative proposing to include the state social scholarship in the list of incomes protected from garnishment. As noted at the meeting, this amendment will ensure that the full amount of the payment reaches the student and is used for its intended purpose.
“This initiative has already received wide support in the regions, and this is natural. We must create all conditions so that young people, especially those from socially unprotected segments of the population, can obtain an education without unnecessary difficulties. I am confident that our decision will become another weighty argument for the federal center and will help correct the existing gap in the legislation,” said Evgeny Lyulin, chairman of the Legislative Assembly of Nizhny Novgorod Oblast.
