An entrepreneur from Nizhny Novgorod succeeded in having a fine overturned after an error was discovered in the Unified State Register of Real Estate (EGRN).

A company from the Nizhny Novgorod Region succeeded in overturning an administrative fine of 200,000 rubles. Justice was restored thanks to the support of the Commissioner for the Protection of Entrepreneurs' Rights, Pavel Solodky, his press service reported.
The story began at the end of 2021, when, after an inspection of the company's forest fund, it was accused of unauthorized tilling of land. Despite objections, a protocol was drawn up under Article 7.9 of the Code of Administrative Offenses of the Russian Federation and a large fine was imposed.
The entrepreneur appealed to the arbitration court and sought help from the business ombudsman. Solodky drew attention to the fact that the key circumstance was the correctness of the plot boundaries. The very fact of the offense depended on this.
At the ombudsman's initiative, judicial proceedings were launched to identify a registry error in the EGRN. The court appointed two independent expert examinations, heard specialists and examined evidence confirming incorrect boundary depiction.
Staff of the business ombudsman's office participated in the case as a third party: they prepared documents, motions and attended six hearings of the court of first instance.
On 31 May 2024, the Arbitration Court of the Nizhny Novgorod Region recognized the presence of a registry error in the EGRN data. More than 61,000 square meters were excluded from the plot's boundaries after being erroneously classified as forest fund lands.
The Federal Forestry Agency and the regional ministry tried to contest the decision, but the appeal confirmed its legality. On 9 June 2025 Rosreestr made changes to the EGRN, correcting the inaccuracies.
After the registry was corrected, proceedings in the case were resumed. Taking the updated data into account, the court canceled the penalty and found no grounds for holding the company liable.
Pavel Solodky noted that the case demonstrates how critical the quality of information in state registries is. According to him, without the identification of the error the entrepreneur risked not only a fine but also a criminal case for illegal logging.
