Yevgeny Masharov, a member of the Public Chamber of the Russian Federation's commission for the examination of draft laws, warned that the destruction of front gardens and flowerbeds near residential buildings may entail criminal or administrative liability. His words are cited by TASS.
According to Masharov, if someone picks or digs up flowers that residents planted near their homes, such actions may be classified as damage or theft. This may lead to administrative fines, arrests or even imprisonment.
Thus, if flowers are picked and thrown away on the spot, this is considered petty hooliganism under Article 20.1 of the Code of Administrative Offenses of the Russian Federation, punishable by a fine of 500 to 1,000 rubles or arrest for up to 15 days.
If the flowers are taken away but their value does not exceed 2,500 rubles, this is qualified as petty theft under Article 7.27 of the Code of Administrative Offenses of the Russian Federation. Such an offense carries fines of up to five times the value of the stolen property, but not less than 3,000 rubles, arrest for 10–15 days, or compulsory community service for up to 120 hours.
If the value of the stolen flowers exceeds 2,500 rubles, the offender may be brought to criminal liability under Article 158 of the Criminal Code of the Russian Federation. The punishment for this may include imprisonment for up to two years.
