Лидер партии "Новые люди" Вячеслав Даванков обратился к председателю Верховного суда Российской Федерации Игорю Краснову с предложением разработать меры по защите добросовестных покупателей квартир, пострадавших от мошеннических действий. Об этом сообщает издание 360.ru.

      Даванков отметил увеличение случаев квартирного мошенничества в России, в результате которого страдают как покупатели, так и продавцы. Он подчеркнул, что проблема заключается в правовой неопределённости, которая возникает при расторжении сделок.

      Суды чаще всего защищают интересы продавцов, признавая сделки недействительными, но не всегда требуют от них возврата денег покупателю. Это связано с тем, что средства уже были переданы мошенникам. Таким образом, добросовестный покупатель, который тщательно проверил все документы и оплатил квартиру, оказывается без жилья и денег.

      Даванков предложил подготовить разъяснения для судов, которые позволят возместить покупателям стоимость квартиры за счет мошенников, если их удастся установить. В случае, если мошенников не удастся найти, продавец должен будет нести ответственность за возврат средств.

      Напомним, что в последнее время в Госдуму поступает большое количество жалоб на мошенничество на рынке вторичной недвижимости. В связи с этим депутаты начали рассматривать вопрос о введении так называемого "периода охлаждения" для сделок с квартирами.
