When you can complain about the noise of lawn mowers outside your windows: lawyer's advice

Although there is no single federal law on silence in Russia, each region establishes its own norms, said Natalia Kubasova, a lecturer at the Financial University under the Government of Russia, to 360.ru.

      When can you mow and how loud can it be

      In Moscow, as noted by Kubasova, noisy work, including grass mowing, is allowed from 7:00 AM to 1:00 PM, from 4:00 PM to 6:00 PM, and from 7:00 PM to 9:00 PM on weekdays, and on weekends from 10:00 AM to 12:00 PM and from 3:00 PM to 11:00 PM. In the Moscow region, special rules apply: lawn mowers can be used on weekdays from 8:00 AM to 8:00 PM, and on weekends from 10:00 AM to 10:00 PM. Additionally, creating noise is prohibited every day from 1:00 PM to 3:00 PM.

      In the Nizhny Novgorod region, the norms are also enshrined in regional legislation, which establishes quiet hours from 10:00 PM to 7:00 AM on weekdays and from 11:00 PM to 10:00 AM on weekends and holidays, with a mandatory break for "quiet hour" from 12:30 PM to 3:00 PM.

      According to sanitary norms, the noise level during the daytime in residential areas should not exceed 55−70 decibels. However, gasoline lawn mowers produce about 100−110 decibels, which is significantly above the permissible level. Electric models also often exceed the standards.

      Who to complain to and what are the consequences

      If you encounter loud grass mowing at an inappropriate time, it is necessary to document the violation. This can be done with a video recording indicating the date, time, and address, as well as photographs with geolocation. Testimonies from neighbor witnesses can also be helpful.

      The first step is to contact the management company or homeowners' association (HOA), which is responsible for organizing work on the adjacent territory. If there is no response, you can file a complaint with the district police officer (for violating the noise law) or with Rospotrebnadzor (for violating sanitary norms).

      Administrative fines are provided for noise violations. In Moscow, the fine for individuals is up to 2,000 rubles, for officials up to 8,000 rubles, and for organizations up to 80,000 rubles.

      In the Nizhny Novgorod region, the fine is up to 5,000 rubles; for officials, it is up to 15,000 rubles, and for legal entities, up to 30,000 rubles.

      In addition to the fine, the violator will be issued an order to eliminate the violations. Criminal liability for such violations is not provided by law.

      How to escape the noise in the moment

      If the noise has already started, you can try to protect yourself. To do this, you should close windows and balcony doors, as even ordinary glass reduces noise levels by 15−20 decibels. You can also use earplugs, headphones with active noise cancellation, or play white noise (recordings of rain, a waterfall, or a running fan).

      However, lawyer Natalia Kubasova recommends not to delay the complaint and to immediately contact the relevant authorities. A complaint to the management company can be considered an official document that initiates the accountability mechanism.
