      Bailiffs helped a citizen obtain compensation for non‑pecuniary (moral) damage after his personal phone number was disseminated.

      A company manufacturing souvenir and printed products posted on its page in one of the social networks a video showing the business cards previously ordered by the man with a QR code that allows anyone to see the customer’s personal mobile number. The citizen did not give the company consent to process his personal data. This became the basis for filing a lawsuit seeking compensation for moral damage. In his statement the man indicated that after the video was posted he began receiving a large flow of incoming spam calls and spam messages from third parties and fraudsters, and was forced to spend more time and be distracted by processing, deleting and blocking incoming calls. The court decided to recover from the company compensation for moral damage in the amount of 543,000 rubles.

      The corresponding enforcement proceeding was initiated in the Sovetsky District Office of the Bailiffs of Nizhny Novgorod of the Main Directorate of the Federal Bailiff Service of Russia for the Nizhny Novgorod Region. The company did not pay the debt voluntarily. After the deadline expired the bailiff issued an order to enforce recovery from the monetary funds held in the debtor’s settlement accounts. Thus, the debt was recovered in full, including an enforcement fee in the amount of 38,000 rubles.

      Thanks to the measures taken by the officers of the enforcement authorities, the citizen’s right to receive compensation for moral damage has been restored. The enforcement proceeding was closed due to actual execution.
